EL&I is run by Adrian Tyndall, an employment specialist with over eight years experience in employment law.
Adrian graduated from King's College London with a 2:1 in law, winning the Hickling prize in Industrial Law and the King's College prize in legal history. After achieving a distinction in his postgraduate legal practice course in 2001, Adrian undertook a two-year training contract with Eversheds, in their head office in London.
An experienced advocate, Adrian has appeared in the Employment Tribunal over 60 times. Recent notable cases include:
- Cobb v Secretary of State for Health (EAT) – Successful application to strike out appeal notice in breach of time limits and EAT discretion to extend
- Bowers v NHS Pensions Agency – Successfully argued claim was abuse of process and res judicata
- Selby v Tameside Metropolitan Borough Council (Manchester ET) – Claim based on alleged unlawful implementation of local agreement. Successfully argued local agreement was adopted due to custom and practice
- Aspinall & Birkett v Cheshire and Wirral NHS Trust (Manchester ET) – Claim for admittance to NHS pension scheme based on discriminatory policy struck out
- Fenna v NHS Business Services Authority (Bristol ET) - Successfully argued a career break was a break in service for the purposes of the Equal Pay Act
Adrian is an ACAS trained investigator. Recent investigations include:
- Allegations of drug-taking at local authority care premises, culminating in 200 page report
- Large-scale fraud by local authority services provider
- Falsification of work history by senior local authority executive
Adrian is the author of Patriotism and Principles: Order 1305 and the Betteshanger Strike of 1942 (Historical Studies in Industrial Relations) 2001
